====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 06-11-2019 Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner, who is in custody, seeks bail in connection with Sessions Trial No.407 of 2018, arising out of Hathidah P.S. Case No.81 of 2017, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.
Petitioner had earlier moved this Court for regular bail vide Cr.Misc.No.61504 of 2018, which was dismissed on 02.11.2018,considering the nature of allegation against the petitioner.
Considering the fact that there is direct allegation against the petitioner of firing upon the chest of father of the
Patna High Court CR. MISC. No.58764 of 2019(2) dt.06-11-2019 2/2 informant by pistol, due to which father of the informant died on the way to hospital, I am not inclined to enlarge the petitioner on bail at this stage.
Accordingly, the prayer for bail of the petitioner is rejected. However, the petitioner may renew his prayer for bail after one year.
