2. The petitioner has prayed for bail in connection with Nokha P.S. Case No. 114 of 2025 registered for the offence punishable under Sections 103(1) and 238 of the B.N.S., 2023.

3. The case of the prosecution in short is that some unknown miscreants have killed a lady and have thrown her in the fields.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that a spy was appointed, and the spy disclosed that one Munna @ Arvind Chaudhary was living with the deceased. In Para-17, Munna @ Arvind Chaudhary has

No.56650 of 2025(4) dt.08-12-2025 2/3 given his confessional statement and has stated that the deceased was living with this petitioner for many years and she used to work as a dancer. He came in contact with the deceased while he was gone to see a dance program in Balrampur after they were on talking terms. He was with the deceased for four days, which was not liked by Akhilesh Kumar, and he has threatened her of dire consequences. After this, the police recorded the confessional statement of this petitioner. He further submits that save and except the confessional statement, there is nothing against this petitioner. It has also been submitted that police have also collected CDR, but the CDR of the petitioner and the deceased was never found at a place at a point in time. From perusal of the post-mortem report, it transpires that the death was caused by asphyxia due to strangulation. Moreover, the petitioner is languishing in judicial custody since 24.04.2025.

5. The application for bail is opposed by learned APP for the State and submits that the petitioner has criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named
