Petitioner being Bank Manager is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 120B, 467, 468, 471, 420, 379 of the Indian Penal Code.

It is alleged that complainant got a tractor from the dealership of the co-accused Anil Singh by getting the loan sanctioned from Magadh Gramin Bank where the petitioner was the Branch Manager. Subsequently it was found that tractor was not functioning properly and engine of the tractor was found old. Subsequently for recovery of the loan amount notice was received by the complainant and ultimately

Patna High Court Cr.Misc. No.31921 of 2015 (2) dt.06-08-2015 2/2 the tractor was seized.

It is submitted by learned counsel for the petitioner that tractor was purchased in 2005 whereas the complaint was filed in 2013 and the petitioner has been transferred from the Magadh Gramin Bank in 2007. Considering the nature of accusation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Aurangabad in connection with Complaint Case No. 95 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
