Patna High Court MJC No.3144 of 2016 (3) dt.30-11-2016 2/2 30-11-2016 Heard learned counsel for the petitioner and learned counsel for the State.

This application has been filed for restoration of CrWJC No. 1023 of 2015 which stood dismissed for want of prosecution on 28.07.2016.

It is contended by the learned counsel for the petitioner that on 28.07.2016, one of his close relatives became seriously ill and was referred to PMCH, Patna. In that circumstance, he had to rush to the hospital to attend him and that is why he failed to appear before the Court when the case was taken up.

On the facts and in the circumstances of the case, the prayer is allowed. CrWJC No. 1023 of 2015 is restored to its original file.
