JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Bhagwan Bazar P.S. case No. 61 of 2015, disclosing offences under Sections 272 & 273 of the Indian Penal Code and Section 47(A) of the Bihar Excise Act.

The allegation against the petitioner is that during raid conducted by the police in the premises in question, two persons were arrested, who, while disclosing their identity as Salesmen, named the petitioner to be owner of the said shop. Learned counsel for the petitioner submits that the petitioner has wrongly been implicated and he has a valid licence for running country made liquor shop. Referring to the statement

Patna High Court Cr.Misc. No.32356 of 2015 (2) dt.13-08-2015 made in the paragraph 3 of the application, learned counsel for the petitioner submits that the prosecution launched in Bhagwan Bazar P.S. Case mp/ 49 of 2014 and Chapra Town P.S. Case No. 119 of 2014 has been quashed by this Court by an order dated 07.07.2015.

In view of the submissions as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra in Bhagwan Bazar P.S. Case No. 61 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall liable to be cancelled.
