In this case, the petitioner is apprehending his arrest in connection with Banka P.S. Case No. 603 of 2016 registered for offences under sections 406, 420, 379, 120B, 34 and subsequently added Section 411 of the Indian Penal Code.
The petitioner is not named in the First Information Report but, an allegation has been made that the driver was set out for the destination of Deogarh with 281 bags of wheat, when a call was given, he has given a different version of Jam at different places. Later on, he has switched off his mobile and, on that account, suspicion was raised. The Informant has started searching, ultimately the wheat were recovered which were in the
Patna High Court Cr.Misc. No.24932 of 2017 (3) dt.10-08-2017 process of sale. The driver, who is the son of the owner of the vehicle, has made a statement that on the direction of one Tarkeshwar, he has connived with the petitioner for sale of the goods.
This Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner, namely, Mukesh @ Pramod Yadav @ Mukesh Kumar Yadav is rejected.
If the petitioner surrenders before the court below within a period of four weeks from today and prays for bail, the court below will consider the same and will pass orders in accordance with law without being prejudiced by the present order. While considering the prayer for bail, the court below will also take into account that other co-accused persons have already been granted bail.
