2. The petitioner seeks regular bail in connection with Dehri (M) P.S. Case No. 48 of 2025, dated 28-03-2025, registered for offences punishable under Sections 137(2), and 98 of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in short, is that on 28.03.2025 at about 4:30 AM, ASI Janak Ram, while on patrolling duty, saw the petitioner, Ghuran Ram, with two minor girls on a motorcycle who turned away upon seeing the police. After being apprehended, the petitioner claimed that he was taking the girls to Punjab for work after they approached him at Sasaram. He said the girls had run away from their hostel and

The girls stated that they had run away from Ambedkar School Hostel, as they were not interested in continuing their studies, and were going with the petitioner voluntarily. The police claimed that petitioner with wrongful purpose, was taking the minors to Punjab without informing their guardians or local authorities.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that the petitioner is an e-rickshaw driver, and on the date of occurrence, two girls approached him, informing that there was no train available to Dehri Railway Station and requested him to drop them there. The petitioner initially declined, stating that the battery of his erickshaw was low and he could not take them. However, upon their insistence, he brought his motorcycle and agreed to drop them at Dehri Railway Station. While on the way, the police intercepted and detained them. Learned counsel further submits that neither of the two girls made any complaint against the petitioner alleging kidnapping or any wrongful act, nor has any FIR or complaint been lodged against the petitioner either by the girls or their parents. 5. Learned Additional Public Prosecutor for the State has opposed the prayer.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM Dehri Rohtas at Sasaram, in connection with Dehri (M) P.S. Case No. 48 of 2025.

7. The application stands allowed.
