2. The petitioner has preferred this application for grant of regular bail in connection with Pasraha P.S. Case No. 270 of 2024 dated 06.11.2024 registered for the offences punishable under Sections 109, 121(2), 132, 118(2) of B.N.S. and Section 25(1-B)(a), 25(1-A), 26(2) and 27 of Arms Act.

3. As per the prosecution case, the co-accused is alleged to have fired on the head of SHO with intention to kill, due to which he fell on the ground and blood started oozing out, thereafter, the co-accused was apprehended by the police personnel. On search, one country-made pistol, four live cartridges and mobile phone were recovered from the

Patna High Court CR. MISC. No.57077 of 2025(2) dt.20-08-2025 2/3 possession of the co-accused, Raja Kumar. It is further alleged that the co-accused, Raja Kumar disclosed that in order to take revenge of murder, the petitioner and the co-accused persons gathered with lots of weapons.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. There is no specific allegation against the petitioner rather the allegation of firing is against the co-accused, Raja Kumar. The name of the petitioner has sprung up in the confessional statement of the co-accused, Raja Kumar. The petitioner has no concern with the alleged occurrence. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 24.03.2025.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Pasraha P.S. Case No.
