2. The petitioner is apprehending his arrest in connection with Sursand P. S. Case No. 306 of 2022 registered on 14.06.2022 for the offences punishable under Section 30(a) of Bihar Prohibition & Excise Act.
3. According to the prosecution, total recovery of 54 litre of wine, which is the subject matter of the present case.
4. Learned counsel for the petitioner submits that petitioner has not apprehended from the place of occurrence nor anything has been recovered from his possession. Counsel further submits that the name of the petitioner has figured in this case by virtue of confessional statement of co-accused. He further submits that antecedent of the petitioner is clean and no

5. Learned APP for the State opposes the prayer for bail.
6. In the aforesaid facts and circumstances, let the above-named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within 6 weeks from today, on furnishing bail bond of Rs. 30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Exclusive Excise Court-II, Sitamarhi in connection with Sursand P.S. Case No. 306 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
