The petitioner apprehends his arrest in a case registered for the offence under Section 379 of the Indian Penal Code, Section 4 / 40 of Bihar Mining Act and Section 3 / 4 of the Explosive Substance Act.

As per the prosecution case, thirteen pieces of detonator were found in the dicky of the motorcycle of coaccused Anil Singh. Petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of investigation on the basis of application filed by wife of co-accused Anil Singh. No incriminating article has been recovered from the possession of the petitioner and he has got no concern with the seized detonator. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.68116 of 2021(3) dt.12-07-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram (M) P.S. Case No. 216 of 2013, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
