The petitioner apprehends her arrest in Patahi P.S. Case No. 52 of 2016 registered for the offences punishable under Sections 366(A) and 34 of the Indian Penal Code. The informant alleged that Lal Kishore Singh kidnapped her sister. The petitioner is not named in the FIR. The petitioner dragged into the case only because she happens to be the wife of Lal Kishore Singh. The victim made her statement under Section 164 of the Code of Criminal Procedure and she made specific allegation against Lal Kishore Singh and Raja Kumar who kidnapped her and committed rape with her.

Considering the facts aforesaid and the fact that neither the informant nor the victim named the petitioner and the

No.25988 of 2017 (2) dt.13-07-2017 2/2 petitioner is a lady, she above named in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in Patahi P.S. Case No. 52 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
