The petitioners being mother-in-law and father-inlaw apprehend arrest in a case registered for the offences punishable under sections 304(B), 120(B) of the Indian Penal Code.
Case diary in the present case was called for which has since been received.
Learned counsel for the petitioners submits that though an allegation has been made against these petitioners, they have been living separately from their son as their son had married the girl out of love and since these petitioners were not agreeable to the said marriage, they were separate in mess and residence.
Patna High Court Cr.Misc. No.32630 of 2015 (4) dt.04-11-2015 Learned counsel for the State after perusal of the case diary submits that, in fact, these petitioners were living separately.
Considering the aforementioned facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri S. K. Singh, Judicial Magistrate, 1st Class, Araria in connection with Palasi P.S. Case No 40 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
