JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and the State. Apprehending his arrest in connection with Saharsa Mahila P.S. case no. 28 of 2017, registered under Sections 498A, 323, 379, 504 and 506/34 of the IPC, the present application is for grant of anticipatory bail.

It is stated that the petitioner has two children from the informant. He is ready and willing to keep his wife and two children with him. It is also stated that for this purpose a prayer was made in the Court below but despite notice the informant did not appear. If the Court grants the privilege of anticipatory bail, he shall take all necessary steps in the light of the stand taken before this Court.

In the facts and circumstances of the case, in the

No.25936 of 2017 (2) dt.07-07-2017 2/2 event of his arrest or surrender before the Court below within a period of four weeks from today, the petitioner, named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Saharsa, in connection with Saharsa Mahila P.S. Case No. 28 of 2017, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 with the further following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.

(ii) Along with the bail bonds the petitioner shall produce receipt/document/paper showing payment /deposit of a sum of Rs.

10,000/- (ten thousand) in favour of the informant. It will also be open to the petitioner to enclose the demand draft favouring the informant(wife) along with bail bonds.
