The petitioner is in custody in connection with Bhaktiyarpur (Balwa hat O.P.) P.S. Case No. 164 of 2019 for the offence under Sections 392, 411 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner in the instant case is that he snatched motorcycle of the informant. The petitioner has been arrested merely on the disclosure of personality description by the informant. The motorcycle was not recovered from the conscious possession of the petitioner. The petitioner is in custody since 30.04.2019.
Considering the fact that the motorcycle was not recovered from the possession of the petitioner, the Court is
Patna High Court CR. MISC. No.53975 of 2019(2) dt.30-08-2019 2/2 inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bonds of Rs. 25,000/-(Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur (Balwa hat O.P.) P.S. Case No. 164 of 2019.
