The petitioner has filed this writ petition against the selection of respondent no.7, namely, Yugesh Kumar as licensee of P.D.S. shop.

Learned counsel for the petitioner submits that the petitioner has got higher marks in Intermediate Examination and, therefore, the licence should have been granted to her but from perusal of the provision as contained in Clause 9(v) of the Bihar Targeted Public Distribution System (Control) Order, 2016, it appears that the basic qualification of the applicant for

Patna High Court CWJC No.18398 of 2019(2) dt.25-11-2020 2/2 licence is matriculation. Respondent no.7 got higher marks in matriculation and, therefore, respondent no.7 was granted licence.

Having considered the submissions of both sides, I find no illegality in the selection process. Accordingly, this writ petition is dismissed.
