The petitioner apprehends his arrest in Alipur P.S.Case No.09 of 2016 under Sections 147, 149, 341, 323, 324, 307, 504, 506, 527 and 530 of the IPC.

Baldeo Singh, the informant named eight persons including the petitioner Bhuee Yadav and alleged that Rampravesh Yadav assaulted his brother Laldeo Singh with khanti on his head and thereafter all the accused persons assaulted the informant and his brother. The informant got one injury which is grievous in nature and the same is attributed to Rampravesh Yadav. There is no specific allegation of assault against the petitioner. Binod Yadav, Darshan Yadav and Rajeshwar Yadav have already been granted anticipatory bail vide Cr.Misc.No.25908 of 2016 by a

Patna High Court Cr.Misc. No.39830 of 2016 (3) dt.04-10-2016 2/2 coordinate Bench of this Court. The case of the petitioner stands on better footing.

Considering the aforesaid facts, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of ACJMVI, Gaya in connection with Alipur P.S.Case No.09 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
