2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 467, 468, 471 and 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition Excise Act.
3. Prosecution case relates to recovery of 894.6 liters of illicit liquor from the Bolero Pickup vehicle bearing Reg. No. BR07GA7031 and this petitioner is the owner of the said vehicle.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on suspicion. The petitioner was neither apprehended on spot nor he has any

No.60967 of 2023(2) dt.22-09-2023 2/2 concern with the alleged recovery because the petitioner gave the vehicle for commercial use to one co-accused Amarjeet Kumar Mandal(driver of the said vehicle) who has already been granted bail by the co-ordinate Bench of this Court vide order dated 22.05.2023 in Cr. Misc No. 25711 of 2023. Nothing has been recovered from the conscious possession of the petitioner. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 31.03.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Biraul P.S. Case No. 494 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge-2 (Excise Act), Darbhanga.
