ANJANA PRAKASH ORAL JUDGMENT Date: 20-06-2016 The Petitioner seeks revision of the judgment of conviction dated 13.12.2006 passed by the Additional Sessions Judgecum-Fast Track Court No.III, Aurangabad in Criminal Appeal No.33 of 2006/ 01 of 2006, by which he has upheld the conviction of the Petitioner under the provisions of Arms Act and maintained the sentence of 3 years R.I. and fine of Rs.4000/-, in default of which simple imprisonment for another three months, passed by the Judicial Magistrate, 1st class, Aurangabad in G.R. No.2033 of 1996 (Trial No.985 of 2006) by judgment dated 4.3.2006.
On going through the impugned judgment, I do not find any merit in the revision. However, considering the period of custody of the Petitioner as also the date of occurrence, the sentence is modified to the period already undergone by him. The realization of
Patna High Court CR. REV. No.357 of 2007 dt.20-06-2016 2/2 fine of Rs.4000/- imposed upon the petitioner is also waived. With the aforesaid modification in sentence, the revision application stands dismissed.
