2. The petitioner seeks regular bail in connection with Chakki P.S. Case No. 84 of 2025 for the offences registered under Section 30(a) of the Bihar Prohibition & Excise Act.

3. There is recovery of 115.8 litre illicit liquor from the old house of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Recovery has been made from the petitioner's old house which is unoccupied as the petitioner and his entire family have shifted to a newly constructed house. The old house is abandoned and easily accessible to any one. Nothing has been recovered from the conscious possession of the petitioner.

Patna High Court CR. MISC. No.57059 of 2025(2) dt.21-08-2025 2/2 Petitioner has one criminal antecedent in which he is on bail. He is in custody since 08.07.2025. Petitioner undertakes to cooperate in the trial.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties and facts and circumstances of the case, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court of Exclusive Excise Special Judge, Excise Court No. 2, Buxar in connection with Chakki P.S. Case No. 84 of 2025.
