The petitioners apprehend their arrest in connection with Birpur P.S. Case no. 117 of 2016, registered under Sections 447, 341, 323, 325, 307, 504, 379 and 435/34 of the Indian Penal Code. The allegation of informant Md. Samsher is that on 20.12.2016, when he was at home then at about 10.30 A.M., 19 persons named in the F.I.R., including the petitioners, reached there having variously armed in their hands. At that time petitioners and one Md. Mustafa caused injury through lathi to Md. Irsad, Md. Mumtaj and Gulshan Ara while other accused caused injury to informant and others.
Learned counsel for the petitioners submits that the allegation against the petitioners and one Md. Mustafa is to cause
Patna High Court Cr.Misc. No.26265 of 2017 (3) dt.08-09-2017 2/2 injury to Md. Irsad, Md. Mumtaj and Gulshan Ara, but the injuries found on their persons are simple in nature, which would appear from Anexure-2 series of the supplementary affidavit. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the ACJM-I, Begusarai in connection with Birpur P.S. Case No. 117 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
