Petitioner is apprehending his arrest in connection with Uda-Kishunganj P.S. Case No. 231 of 2017 for the offences registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.
Informant is a police officer has stated in his written complaint that on 28.12.2017 at 10:00 P.M. he received a secret information that illegal liquor is coming from Jharkhand in a truck bearing truck No. BR-11GA-7171. On said information he reached there and recovered 300 grams of liquor from the truck and seizure list was prepared.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.33475 of 2018(3) dt.06-09-2018 2/2 he is innocent and he has committed no offence. No illegal liquor has been recovered from his possession. He has been falsely implicated in this case due to ill motive of police. He has no criminal antecedent.
Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Uda-Kishunganj District Madhepura in connection with Uda-Kishunganj P.S. Case No. 231 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
