JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The name of this petitioner came in confessional statement of co-accused, Vikash Kumar Tiwary. The victim boy was recovered on the basis of disclosure made by the aforesaid coaccused, Vikash Kumar Tiwary. Similarly, the mobile phone, which had been used in committing the alleged crime, was recovered from possession of co-accused, Satish Kumar Tiwary. So far as petitioner is concerned, neither mobile phone which had been used in the present crime was recovered from his house nor the victim was recovered from his house and it appears that on the basis of some call details and confessional statement of coaccused, he has been made accused in this case. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-X, Saran at Chapra in connection with Sessions Trial No. 219 of 2015 arising out of Chapra Town P.S. Case No. 87 of 2015.
