The petitioner apprehends his arrest in connection with Aurangabad (Muffasil) P.S. Case No. 37 of 2017 for the offences registered under Sections 379, 411 of the Indian Penal Code and Sections 3, 4 and 5 of the Mines Act. Learned counsel for the petitioner submits that the sand in question, which was seized from the vehicle driven by the present petitioner, was in fact genuine sand, which had been loaded by the owner of the vehicle. The petitioner has no role to play, save and except, he was driving the vehicle in question. Considering the aforesaid facts and circumstances of the case and that the petitioner has got no criminal antecedent, let the

No.27080 of 2017 (2) dt.07-07-2017 petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Muffasil) P.S. Case No. 37 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
