The petitioner has filed this application seeking a direction to the respondents to start teaching activities in the affiliated and Upgraded Secondary School Shankar Yadav Tola, Panchayat Englishiya, Bagha-1 Prakhand in the district of West Champaran.

It is the case of the petitioner that though the school in question was upgraded from the Middle School in the year

Patna High Court CWJC No.16001 of 2016(4) dt.02-11-2017 2/2 2015, the teaching activities have not been done. A counter affidavit has been filed on behalf of the State of Bihar stating therein inter alia that there is another school not far away in the name of Jaini Tola School in the same panchayat which has been upgraded to the secondary level and teaching activities up to that level in the said Jaini Tola School has started.

In view of the statement made in the counter affidavit, no direction need be issued as sought for on behalf of the petitioner in the present facts and circumstances of the case. It goes without saying that the petitioner shall have liberty to approach this Court, if a case for upgradation or starting teaching works of the school in question, i.e., Upgraded Secondary School Shankar Yadav Tola, Panchayat Englishiya, Bagha-1 Prakhand in the district of West Champaran is made out in future.

This application stands disposed of.
