The petitioner apprehends his arrest in Kadamkuan P.S. Case No. 224 of 2014, registered for the offences punishable under Sections 419, 420 and other Sections of the Indian Penal Code.

Allegation against the petitioner is that he set up Ajay Kumar, who was caught red handed while appearing at the examination of BCECE 2nd Stage, 2014 at the place of the petitioner.

Submission is that the petitioner has not committed any overt act.

It appears from the records that Ajay Kumar was appearing at the examination and from his possession admit card

Patna High Court Cr.Misc. No.34383 of 2014 (2) dt.18-02-2015 2/2 having photograph of the petitioner was recovered as he was appearing in place of the petitioner.

Considering the facts aforesaid I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
