The petitioner is apprehending his arrest in connection with Majhuwaliya P.S.Case No.448 of 2017 registered for offences punishable under Sections 366(A)/34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping of the minor girl of the informant.
Submission of the learned counsel for the petitioner is that he has been made accused because he had solemnized marriage with her.
Heard learned A.P.P., who has opposed the prayer for bail stating that in her statement recorded under Section 164 Cr.P.C. she has disclosed the name of the petitioner as kidnapper. Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.34261 of 2018 (3) dt.25-08-2018 2/2 circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
With the aforesaid observation, this application is dismissed.
