The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 406,409,420/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the present First Information Report has been lodged alleging that the petitioner had taken money from a few recipients of Old Age Pension Scheme. He submits in this context that neither the petitioner is a Government servant nor Mukhiya or any persons responsible for the release of Old Age Pension amount and, therefore, the petitioner has been roped into the present case only on account of local village politics.
Patna High Court Cr.Misc. No.32622 of 2015 (2) dt.18-08-2015 P2/2 Considering the aforementioned facts and circumstances and also the fact that the petitioner is not a government servant or any persons responsible for release of Old Age Pension, let the petitioner Pramod Yadav, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate Saharsa in connection with Nauhatta P.S. Case No. 160/14 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
