This application for grant of anticipatory bail arises out of Kauakol P.S. Case No. 80 of 2016, disclosing offence under Section 379 of the Indian Penal Code.
Considering the fact that the petitioner has criminal antecedent inasmuch as he is an accused for an offence under Sections 379, 420 and 120B of the Indian Penal Code in Koderma P.S. Case No. 61 of 2015, I am not inclined to grant the privilege of anticipatory bail to the petitioner.
Accordingly, this application for anticipatory bail is, hereby, rejected.
The petitioner is directed to surrender before the court below within four weeks from today and seek regular bail, if so
Patna High Court Cr.Misc. No.42169 of 2016 (3) dt.19-10-2016 2/2 advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail. (Chakradhari Sharan Singh, J) Vats/-c U T
