JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and learned APP representing the State.

The petitioner apprehends his arrest in connection with Lauriya P.S. Case No. 77 of 2017 registered for the offences punishable under Sections 341, 323, 353, 379, 511, 504, 506 of the Indian Penal Code.

Allegedly, when the informant, J. E. Electricity Department, Lauriya, along with other electricity officials went at the house of the petitioner for collection of government revenue then the petitioner abused and gave threatening and also used criminal force to deter him from discharging his official duty and tried to snatch government amount.

Submission is of false implication and that the petitioner is the consumer of Electricity Department and he paid

Patna High Court Cr.Misc. No.26845 of 2017 (2) dt.13-07-2017 up-to-date bills of electricity. Recently excess bill has come and for correction of the same the petitioner tried his best and being annoyed with the steps taken by the petitioner this false case has been lodged.

Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Ist, Bettiah, West Champaran in connection with Lauriya P.S. Case No. 77 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
