The petitioner seeks bail in a case registered for the offences punishable under Sections 457 and 380 the Indian Penal Code. Later on Section 411 of the Indian Penal Code was added. A theft was committed in the house of Sanjiv Kumar the informant. Ornaments, cash and mobile phone etc. were stolen. The petitioner is not named in the FIR. One of the co-accused Shyam Kumar Ram was arrested and from his possession stolen mobile was recovered. Shyam Kumar Ram disclosed the name of the petitioner and except the confession of the accused there is no material against the petitioner. Shyam Kumar Ram has already been enlarged on bail.

Considering the facts aforesaid, the petitioner above

Patna High Court Cr.Misc. No.32689 of 2015 (2) dt.19-08-2015 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Anupam Kumari, the learned Judicial Magistrate, 1st Class, Muzaffarpur in Musahri P.S. Case No. 10 of 2015.
