JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 20-12-2016 This writ petition has been filed by the petitioner for directing the respondents to pay the amount of Rs.02,01,166/- under the head of Group Gratuity-cum-LIC.

The petitioner was appointed as peon in Sone Command Area Development Agency, Sone Bhawan, Patna on 22.11.1975. He retired on 31.07.2015 after attaining the age of superannuation. The grievance of the petitioner is that without any valid reason the respondents have withheld the amount of Group Gratuity-cum- LIC.

Learned counsel appearing on behalf of

Patna High Court CWJC No.15012 of 2016 dt.20-12-2016 2/2 respondents no. 2 to 4 submits that in case the petitioner files a representation regarding his grievance before the respondent no. 2, the same would be disposed of by a reasoned and speaking order within two weeks from the date of its filing. 4.

Considering the fair stand of the learned counsel for the respondents, I direct the petitioner to file a fresh representation before respondent no. 2 raising all his grievances within two weeks from today and in case such a representation is filed, respondent no. 2 would be obliged to dispose of the same by a reasoned and speaking order within two weeks from the date of its filing. He shall also be obliged to make payment of the admissible amount to the petitioner within one week thereafter. In case, the respondents fail to pay the admissible amount to the petitioner within the period stipulated hereinabove, the same would earn interest at the rate of eight per cent per annum from the date it became due till the date of actual payment. 5.

With these observations and directions, the writ petition stands disposed of.
