2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 126 ( 2 ), 115 (2), 118
(1) , 118 (2), 109 (1) and 3(5) of BNS.
3 . The prosecution case in brief, is that informant namely Birbal Bhagat alleged that on 28.10.2024 at about 11:45 AM, on account of long standing land dispute , all the F.I.R. named accused persons including this petitioner assaulted informant. It is further alleged that this petitioner is alleged to have assaulted on the head of informant with hammer.
4. It is submitted on behalf of the petitioner that both parties are close relatives. There is admitted land dispute
Patna High Court CR. MISC. No.57484 of 2025(2) dt.02-09-2025 2/2 between the parties. Allegation of assault is general and omnibus against this petitioner. Injury caused by this petitioner is found to be simple in nature . Petitioner claims clean antecedent.
5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, nature of injury , clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge - XIV Gopalganj in connection with Gopalpur P.S. Case No. 262 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
