JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 Petitioner seeks regular bail in connection with Barahiya P. S. Case No. 31 of 2018, registered for the offences punishable under Sections 25(1-b)a and 26 of the Arms Act. Recovery of one country made pistol and petitioner happens to be the accused persons in other cases. Earlier prayer for bail of the petitioner was rejected, vide order dated 12.12.2018 passed in Criminal Misc. No. 69623 of 2018.
Submission of the learned counsel for the petitioner is that he is custody for about 18 months and up-till-now, charge has not been framed.

Having heard both sides, considering the period of incarceration, let the petitioner, above named, be released on
Patna High Court CR. MISC. No.56164 of 2019(3) dt.25-09-2019 2/2 bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Barahiya P. S. Case No. 31 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that he has to co-operate in framing of the charge and also to co-operate in the disposal of the trial, otherwise, his bail bonds shall be cancelled.
