2. This application has been filed for setting aside the FIR bearing Ara Nawada P.S. Case No. 139 of 2019 registered for the offence under Sections 166(A) and 174 of the Indian Penal Code and under Section 9 of the Bihar School Examination Board Act, 1981.

3. Learned counsel for the petitioner submits that this case is squarely covered by the Judgment of this Court in Dr. Anil Kumar Sinha and Ors. Vs. State of Bihar and Ors.

4. Learned counsel for the BSEB, learned counsel for the VKSU and learned APP for the State also accept this fact.

5. In view of the above and for the grounds mentioned in the order dated 12.09.2022 passed in Cr. W.J.C. No. 1650 of 2019, this application is allowed.

6. Accordingly, the FIR bearing Ara Nawada P.S. Case No. 139 of 2019 and all the subsequent proceedings arising out of the aforesaid FIR is hereby quashed.
