JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner, and the learned counsel representing the State.
The petitioner apprehends his arrest in connection with Aurangabad Town P.S Case No. 156 of 2016 registered for the offences punishable under Sections 406, 409/34 of the Indian Penal Code.
Allegedly, the petitioner and other co-accused did not deposit the amount of sold admission forms with prospectus and misappropriated the college amount.
Submission is of false implication and that now the said amount has already been deducted from arrears salary and no dues certificate has been granted by the Principal of the college
Patna High Court Cr.Misc. No.26809 of 2017 (2) dt.13-07-2017 2/2 concerned vide annexure-2 and, as such, now the petitioner deserves sympathetic consideration.
Learned A.P.P. fairly submits that later on the amount has been deducted from the salary of the petitioner after lodging the F.I.R.
In the facts and circumstances stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of the order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Aurangabad Town P.S. Case No. 156 of 2016 subject to the conditions as laid down in Section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J) sushma/- U T
