Mr. Ravindra Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Baruraj P.S. Case No. 150 of 2021 registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 13.05.2022.

The informant alleges that her daughter was married to Md. Azhar Ali on 13.06.2019 and after marriage, she was regularly being tortured for dowry as the accused persons were demanding an Apache motorcycle, it is next alleged that on 03.08.2021 the informant had gone to meet her daughter but she

Patna High Court CR. MISC. No.67756 of 2022(2) dt.29-04-2023 2/3 was not allowed to meet her and thereafter on 04.08.2021 when again she went to her matrimonial home where she did not find anyone, thus, based on suspicion alleges that her daughter was killed and her dead body was concealed.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in the present case, it is next submitted that petitioner is the father-inlaw of the victim. It is also submitted that till date the dead body has not been recovered, it is next submitted that the victim had eloped after marriage with her lover. It is next submitted that even from perusal of the allegations as alleged in the FIR, it would manifest that no such specific allegation is alleged against this petitioner and further it is the duty of the husband to ensure the well being of his wife.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Baruraj P.S. Case
