The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Section 394 of the Indian Penal Code.
Learned counsel for the petitioner has brought on record in paragraph No. 3 several cases lodged against him and in all the said cases, the petitioner has been extended the privilege of anticipatory bail. So far as the present case is concerned, the petitioner is apprehending his arrest on the basis of self-made confessional statement before the police which has no evidentiary value. It is also submitted that, if at all, the petitioner had made a confession, he ought to have been remanded at the very first instance.
Patna High Court Cr.Misc. No.27575 of 2017 (2) dt.18-07-2017 P2/2 Considering the entire fact and circumstances of the case, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Fenhara P.S. Case No. 63 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
