ANJANA MISHRA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Riga P.S. Case No. 196 of 2016 for the offences registered under Sections 366(A), 372, 373 and 120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire first information report is an afterthought and has been lodged one month after the date of occurrence for which no plausible explanation has been offered by the informant. It is further submitted that the victim girls have since been recovered and in their statement under Section 164 Cr.P.C. they have merely taken the name of the petitioner as one of the associates but now, the marriage has been solemnized with one Mahesh Rai.

No.27474 of 2017 (2) dt.13-07-2017 Considering the fact that there is no specific allegation against this petitioner and the main allegation is against Mahesh Rai and that one Arun Bhagat, whose name has been similarly appeared in the first information report, has since been extended the privilege of anticipatory bail vide order dated 28.02.2017 passed in Cr. Misc. No. 8120 of 2017 and that the petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Riga P.S. Case No. 196 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
