JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 02-04-2025 Heard Mr. Kumar Prabhakar, learned counsel for the petitioners, learned counsel for the informant and Mr. Anil Kumar Singh No. 1, learned APP for the State.
2. At the outset, learned counsel for the petitioners has submitted that petitioner No. 1, namely, Mahendra Prasad @ Mahendra Singh has been granted bail by the learned Coordinate Bench of this Court vide order dated 05.09.2024.
3. Learned counsel for the petitioners is pressing this application for grant of regular bail in respect of petitioner no.2, namely, Mina Devi @ Meena Devi in connection with Kadamkuan P.S. Case No. 290 of 2024 registered for the offence
Patna High Court CR. MISC. No.60399 of 2024(6) dt.02-04-2025 2/3 punishable under Sections 304(B)/34 of the Indian Penal Code.
4. The case of the prosecution is that the niece of the informant, namely, Simple Kumari @ Chhoti Kumari was married to one Sujeet Kumar on 26.11.2022. It is further alleged that she was subjected to cruelty on account of non-fulfillment of dowry demand by her in-laws and ultimately she was being killed.
5. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. The petitioner is mother-in-law of the deceased and she has been falsely implicated in this case. There is no specific allegation against her. The husband of the deceased is already in custody. It has also been submitted by learned counsel for the petitioner that father-in-law of the deceased has already been granted bail by learned Co-ordinate Bench of this Court. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Petitioner is an old lady and she is languishing in judicial custody since 12.04.2024.
6. The application for bail is opposed by learned APP for the State and learned counsel for the informant. The learned counsel for the informant has submitted that the trial is at the
Patna High Court CR. MISC. No.60399 of 2024(6) dt.02-04-2025 3/3 verge of conclusion.
7. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner no.2, namely, Mina Devi @ Meena Devi on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Court of J.M.F.C.-XIV, Patna in connection with Kadamkuan P.S.
