In such view of the matter, this Court has no other alternative but to dispose of this case on its merit. In the present case, the petitioner had applied for the post of Constable on the category of B.S.F./C.I.S.F./C.R.P.F./I.T.B.P./S.S.B./C.P.O. in pursuance of Advertisement published in Rojgar Career Indian dated 03/12/2011.
Patna High Court CWJC No.4304 of 2013 dt.13-01-2016 2/2 The petitioner possess the qualification of matric in 2nd Division, he belongs to O.B.C. category, appeared for Physical Efficiency Test and Physical Standard Test which was cleared by him. As he was declared qualified in Physical Efficient Test and Physical Standard SSC (Middle Area), later on, he was issued Admit card, accordingly, he appeared in the medical examination. Claim has been made that the persons who having lesser marks, have been appointed and the petitioner having higher marks, has been left.
The respondents are directed to examine the case of the petitioner and if it is found that if any person having lesser mark then the petitioner, respondent would pass necessary order in accordance with law within a period of three months from the date of receipt/production of a copy of this order.
Accordingly, this petition is disposed of.
This order has been passed in presence of the counsel for the Union of India.
