2. The petitioner is named in the complaint case and apprehending his arrest in connection with complaint Case No. 240C of 2020 registered for the offences punishable under Sections 420 of IPC.
3. The allegation against petitioner is to cheat complainant for the amount of Rs. 39,900/- which was receivable upon maturity of the scheme floated by M/s Shobharan Multipurpose Society Ltd. Bank, where the petitioner was the agent.

It is submitted by learned counsel appearing on behalf of the petitioner that petitioner was merely an agent and who after purchase of policy upon consent of the informant handover the entire receipt and bond policy to the informant. It is pointed out that the petitioner being agent himself is the victim of the circumstances as suddenly the management of aforesaid company closed its business at Narkatiyaganj. It is submitted that the petitioner is not a person to look over the management and affairs of the company. While concluding argument, it is submitted that petitioner is a man of clean antecedent.
5. Learned APP duly assisted by learned counsel for the informant while opposing the prayer of bail submitted that due to the act of petitioner, complainant suffered a loss of Rs. 40,000/- each for himself and his wife i.e. total of Rs. 80,000/-.
6. In view of aforesaid factual submission and by taking note of fact that as petitioner is the agent where the money, in issue, was admittedly deposited with M/s

Bank, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran /concerned Court, where the case is pending in connection with complaint Case No. 240C of 2020, subject to the conditions as laid down under Section 482(2) of BNSS.
