ANJANA MISHRA ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Aurangabad (Mufassil) P.S. Case No.19 of 2017 for allegedly having committed the offence under Sections 379 and 411 of the Indian Penal Code and Section 4/40 of the Mines Act.
The petitioner is the owner of the truck, which was apprehended along with another truck. It is submitted that though it is alleged that the Moram, which was being carried in the truck, was being illegally transported, the petitioner has valid Challan. It is further submitted that another co-accused, who was also the owner of another truck, has since been
Patna High Court Cr.Misc. No.27328 of 2017 (3) dt.07-07-2017 2/2 extended the privilege of anticipatory bail in Cr.Misc. No.27115 of 2017, vide order dated 29.06.2017. In view of the aforementioned facts and circumstances and that the petitioner is also not having any criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of the learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (Mufassil) P.S. Case No.19 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
