2. The petitioners have preferred this application for grant of regular bail in connection with Gurua 168 of 2024 dated 22.05.2024 registered for the offences punishable under Sections 304B, 201 read with Section 34 of the Indian Penal Code and Section 3 and 4 of Dowry Prohibition Act.
3. As per the prosecution case, the petitioners and the co-accused persons are alleged to have committed murder of the informant's daughter due to non-fulfillment of demand of Rs. 2 lakh as dowry.
4. Learned counsel for the petitioners has submitted
Patna High Court CR. MISC. No.60808 of 2024(2) dt.04-09-2024 2/2 that the petitioners are innocent and have falsely been implicated in this case. There is general and omnibus allegation against the petitioners who are the father-in-law and the brotherin-law of the deceased. The petitioners neither demanded any dowry nor tortured the informant's daughter. The petitioners have no criminal antecedent as stated in para 3 of the bail petition. As per para-18 of the bail petition, the petitioner no.1 is in custody since 24.05.2024 and remanded on 25.05.2024 and petitioner no.2 is in custody since 07.06.2024.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Sherghati at Gaya in connection with Gurua P.S. Case No. 168 of 2024.
7. The application stands allowed.
