1. Heard Mr. Sudhir Kumar Mishra, learned counsel for the petitioner and Mr. Mohammed Arif, learned APP for the State.

2. The petitioner seeks regular bail in connection with Rajoun P. S. Case No. 134 of 2025 dated 20.03.2025 corresponding to G.R. No. 943 of 2025, registered for the offence punishable under Sections 103(1), 238 and 3(5) of the B.N.S.

3. The main submissions advanced by the petitioner's counsel are that the petitioner is a lady, languishing in jail since 21.03.2025 and against her the investigation has been completed, the FIR has been registered against four persons including the petitioner alleging the commission of the murder of the informant's nephew by them but admittedly, the informant is not an eyewitness of the alleged occurrence and the dead body of the

No.56629 of 2025(2) dt.19-08-2025 2/2 deceased was found near the railway track and during the course of investigation, the material witnesses suspected the cause of death of the deceased was due to falling from a moving train and the same possible cause of death has also been mentioned in the inquest report of the deceased and furthermore, during the course of investigation, none of the witnesses claimed to have seen this petitioner or other co-accused persons killing or assaulting the deceased.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

Considering the aforesaid submissions advanced by the petitioner's counsel and mainly petitioner's custody period as well as completion of investigation against him, this court is inclined to release her on bail Accordingly, let the petitioner named-above be enlarged on bail in connection with Rajoun P. S. Case No. 134 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
