JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-08-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307, 328, 379 and some other allied Sections of the Indian Penal Code. As per the prosecution case, this petitioner is alleged to have assaulted the informant with sharp cut weapon and snatched his mobile and golden chain.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case due to animosity. No such event, as mentioned in the FIR, has ever taken place. There is delay in lodging the FIR. Petitioner has got no criminal antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that there is direct and

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
