Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307, 379 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, all the eight FIR named accused persons, including these petitioners, armed with deadly weapon, came at the house of informant, abused and assaulted the informant and others as a result of which three persons

Learned counsel appearing for the petitioners submits that both parties are next door neighbours and Pattidars and a free fight took place in which both sides sustained injuries. The informant sides were aggressor and six persons from the petitioners' side have sustained grievous injuries. Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that petitioners are named in the FIR and there is direct and specific allegation against them that they assaulted the informant and others as a result of which three persons sustained grievous injuries. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioners on pre arrest bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
