2. The petitioner seeks bail in a case registered for the offence punishable under Sections 103(1), 238 and 3(5) of the B.N.S..
3. As per prosecution case, informant got information that Mithun Yadav has been killed by cutting his throat by his mother and brother and the dead body has been buried in a crematorium. Upon receiving such information, informant reached the place of occurrence and the dead body of Mithun Yadav was dug out and a cut injury was found on the front side of neck of the deceased.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Informant is not an eye witness of the alleged occurrence and only on suspicion that this petitioner, who happens to be none else than brother of the deceased, along with other accused persons, has committed the murder, this false and concocted case has been lodged. Similarly situated co-accused, namely Savitri Devi, who happens to be mother of the deceased, has already been granted bail by a Co-ordinate Bench of this Hon'ble Court vide order dated 15.05.2025 passed in Cr. Misc. No. 7435 of 2025. Moreover, charge-sheet has already been submitted. Petitioner has got no criminal antecedents and he is in custody since 19.07.2024.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the facts and circumstances of the case, claim based on parity, period of custody and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten
