JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2018 Petitioner apprehends his arrest in connection with Bhagwanpur P.S.Case No. 112 of 2010 registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code. At the very outset, learned counsel for the State has pointed out that in this case processes under Sectiions 82 and 83 of Cr.P.C. have been issued against the petitioner, as such petitioner is not entitled to anticipatory bail.
Learned counsel for the petitioner has submitted that process report has not been received.
Having heard learned counsel for the State and learned counsel for the petitioner and in the facts and circumstances, let petitioner surrender and make prayer for regular bail, which shall be considered on its own merit and on the basis of materials available on record.
