The petitioner apprehends his arrest in Mansurchak P.S. Case No.57 of 2019 registered under Section 307 and other Sections of the Indian Penal Code.

The informant alleged that Santosh Ram and others were constructing fencing. When the informant forbid, the petitioner is alleged to have assaulted the informant with khanti on his head.

The learned counsel for the petitioner submits that there is a case and counter case. From the side of the petitioner, Mansurchak P.S. Case No.58 of 2019 was registered. Ganesh Ram is alleged to have assaulted the petitioner(informant of Mansurchak P.S. Case No.58 of 2019) with spade on his head and the petitioner got grievous injury. The informant, Ganesh Ram got simple injury which would appear from Annexure -3.

It appears that petitioner and informant are close relative. Petitioner is the son of sister of the informant and on account of land dispute, it appears that both sides engaged in assault on each other but the informant on account of assault made by the petitioner with khanti got simple injury whereas the petitioner sustained grievous injury on account of assault made by Ganesh Ram, informant of the present case. Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Begusarai in connection with Mansurchak P.S. Case No.57 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Saurabh/- U T
