====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-09-2024 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 307, 379, 427, 385, 504, 506/34, 384 of the Indian Penal Code.
3. Prosecution case, in brief, is that on the alleged date and time of occurrence, all the F.I.R. named accused persons including this petitioner assaulted on the head of brother of informant by country made pistol and iron rod. It is further alleged that the accused persons also took away Rs. 3000/-.
4. Learned counsel for the petitioner submits that due to petty dispute, a free fight took place between the parties. Allegation of assault is general and omnibus. Case and counter case. It is further submitted that similarly situated co-accused, namely, Manoj Ram has already been granted anticipatory bail
Patna High Court CR. MISC. No.62006 of 2024(2) dt.30-09-2024 2/2 by co-ordinate Bench of this Hon'ble Court vide order dated 11.09.2024 passed in Cr. Misc. No. 61233 of 2024. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Warisaliganj P. S. Case No. 171 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
